1. Agreement to Terms

By accessing or using The Shadow Map website at the-shadow-map.com ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

These terms constitute a legally binding agreement between you ("User," "you") and The Shadow Map, operated by Dr. Walid Messaoudi ("we," "us," "our").

2. Description of Service

The Shadow Map provides:

• Free AI conversation: A 20-minute conversational interview with Lola, our AI guide trained in depth psychology frameworks. This conversation is always free and requires no payment or credit card.
• Paid Shadow Map report: A personalized 30+ page PDF report analyzing patterns identified during your conversation. This is an optional purchase at the price displayed at checkout (currently €67).

3. Important Disclaimers

Specifically:

• Lola is an AI, not a licensed therapist, psychologist, or medical professional.
• The Shadow Map report is not a clinical assessment or diagnosis.
• Our service does not replace professional mental health care.
• If you are experiencing a mental health crisis, please contact a licensed professional, a crisis helpline, or emergency services immediately.
• We encourage users to share their Shadow Map with a qualified therapist for professional context and support.

4. Eligibility

You must be at least 18 years old to use The Shadow Map. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these terms.

5. User Conduct

When using The Shadow Map, you agree to:

• Provide information that is truthful to the best of your knowledge (the quality of your Shadow Map depends on the honesty of your responses)
• Use the Service only for personal self-reflection purposes
• Not attempt to reverse-engineer, exploit, or manipulate the AI system
• Not use the Service to generate harmful, abusive, or threatening content
• Not impersonate another person during the conversation
• Not share another person's Shadow Map report without their explicit consent
• Not use the Service for any unlawful purpose

6. Pricing & Payment

• The conversation with Lola is free. No credit card is required.
• The Shadow Map report is a one-time purchase at the price displayed on the payment page at the time of purchase (currently €67).
• Payments are processed securely through Stripe. We do not store your credit card details.
• Prices may change at any time. Any price change will not affect purchases already completed.
• All prices are displayed in euros (€) unless otherwise specified.

7. Refund Policy

Refunds are processed to the original payment method and may take 5–10 business days to appear on your statement. Refund requests made after the 30-day window will be reviewed on a case-by-case basis.

8. Intellectual Property

• Our content: The Shadow Map website, branding, AI systems, report templates, and all associated content are owned by The Shadow Map and protected by intellectual property laws. You may not copy, reproduce, or redistribute our platform or its design.
• Your report: Once purchased, your Shadow Map report is yours for personal use. You may share it with your therapist, coach, or trusted individuals. You may not commercially redistribute, resell, or publish it.
• Your conversation data: You retain ownership of the content you share during your conversation. We use it only as described in our Privacy Policy.

9. AI-Generated Content

Your Shadow Map report is generated by artificial intelligence based on the information you provide during your conversation. While we strive for accuracy and insight:

• AI-generated content may not always be perfectly accurate or applicable to your situation
• The patterns, origins, and practices described are interpretive suggestions, not definitive assessments
• We recommend treating your Shadow Map as a starting point for self-reflection, not an absolute truth
• AI technology is evolving, and results may vary between sessions

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Shadow Map is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or that any insights will produce specific outcomes.
• In no event shall The Shadow Map, its operator, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months prior to the claim.

11. Service Availability

We aim to keep The Shadow Map available at all times, but we do not guarantee uninterrupted access. We may temporarily suspend or modify the Service for maintenance, updates, or unforeseen circumstances without prior notice. We are not liable for any loss or inconvenience caused by downtime.

12. Data & Privacy

Your use of The Shadow Map is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in our Privacy Policy.

13. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion if you violate these terms or engage in conduct that is harmful to other users, the platform, or third parties. You may stop using the Service at any time.

14. Changes to Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify users via email or a prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of Spain, without regard to conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Spain.
